Neal Haber is a member of the firm. Neal has represented corporations in litigation and dispute resolution with a concentration in employment and labor law. Neal’s legal practice has encompassed all aspects of labor law, employment and discrimination law and employee relations, with extensive experience in representing management on a nationwide basis in all aspects of employment litigation and in counseling management in related areas, and has also represented senior management in negotiation of employment agreements and in compensation and termination disputes. Neal served for three years as counsel to members of the National Labor Relations Board.

Experience

Labor and Employment Counsel and Representation: Neal provides guidance and support to companies in a variety of industries, including media companies, manufacturers, educational institutions, and sales and supply entities in all facets of labor and employee relations, including:

providing counsel concerning employee management and discipline matters.

preparing executive employment agreements.

preparing separation and exit agreements.

preparing, reviewing and revising employee handbooks and policies.

representing clients in matters before federal, state and municipal fair employment practice agencies and regulatory agencies, including the Equal Employment Opportunity Commission, the New York State Division of Human Rights, the New York State Department of Labor, and other state and municipal agencies before government agencies.

  • Defending clients before National Labor Relations Board, and before federal, state and local fair employment practices agencies
  • Defending client against action by former employee for false arrest and malicious prosecution and asserting counterclaims against the former employee for fraud and misappropriation that resulted in dismissal of the former employee’s claims and judgment of $1.0 million in favor of our client on the counterclaims.
  • Successfully prosecuting a corporate client’s claim against former employee for unfair competition that resulted in a significant settlement paid to our client.

FLSA litigation

representing individuals, our firm has been successful in obtaining judgment for $1.8 million for 12 employees in a wage and hour case;

Obtaining a settlement for $600,000 for 5 employees in a wage and hour case even though the employer had filed for bankruptcy
